Allegations: Medical Malpractice
Chris tore his rotator cuff while loading boxes onto a shelf above his head at work.
He sought medical treatment and was subsequently treated by the Defendant Orthopedic Surgeon and Physician Assistant.
Less than three (3) months later, he underwent rotator cuff repair of his right shoulder.
Unfortunately, the Defendants missed that Chris had torn not only his supraspinatus tendon, but also his subscapularis tendon ; and so the Orthopedic Surgeon only partially repaired Chris’s shoulder.
This was a needless error because an MRI ordered by the Physician Assistant clearly revealed the missed subscapularis tear.
In the months and years that followed my client’s shoulder went from bad to worse.
The tear has progressed and the subscapularis tendon has significantly atrophied and retracted.
The shoulder is now too damaged for repair.
Chris will suffer from permanent pain, weakness, decreased function, and imbalance of his shoulder until his rotator cuff fails completely at which time he will require a reverse total shoulder replacement.
This lawsuit has been scheduled for a Jury Trial in September, 2025.
